TERMS AND CONDITIONS
Terms & Conditions (Hereon known as “T&Cs”) relating to: Street Defence System
STREET DEFENCE SYSTEM (Hereon known as “SDS”, “we”, “us”)
1.1 Street Defence System is managed by Beyomi Ltd, 71-75 Shelton Street, London, WC2H 9JQ, UNITED KINGDOM.
1.2 SDS Terms and Conditions are part of Beyomi T&Cs. You can request via email Beyomi T&Cs and MUST READ before any purchase or final payment is made via Stripe. Any payment or subscription made binds the hereafter and Beyomi’s terms and conditions.
ACCEPTANCE OF MEMBERSHIP
2.1 The decision to accept the application of a potential member shall be at the sole discretion of SDS. SDS reserves the right to verify, or require proof of all information given in order to obtain membership and any fraudulent or wrongful information given in order to obtain such membership could result in the cancellation of all membership rights and lead to the repayment of all monies due to SDS. If the membership application is accepted by SDS, membership of SDS by the applicant shall commence as stated in the agreement.
2.2 The acceptance of an application for membership of SDS shall constitute a legally binding agreement between the member and SDS. The member hereby agrees also to be bound by SDS rules, a copy of which can be provided by request via email at [email protected].
LIMITATION OF LIABILITY
3.1 The member acknowledges that SDS obligations and liabilities in respect of SDS are defined in this agreement and/or within the Regulations Applicable to All Users.
3.2 The member is responsible for the consequences of any use of any of the facilities of SDS. SDS will not be liable for any indirect or consequential loss, damage, costs, expenses, theft or damage to property, whether arising under contract or otherwise.
PHYSICAL HEALTH OF MEMBER
4.1 The member warrants and also represents that he/she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition.
MEMBERSHIP
5.1 The categories of membership are as follows: Group Classes (Mixed group or single-sex classes admittance for up to 2 classes per week for 1 person) and/or any other classes that may be added from time to time at the discretion of the SDS shall be paid Monthly or Quarterly. All membership categories shall be subject to these Terms and Conditions of Membership which are in force at the time.
5.2 Other categories of membership shall be stipulated by SDS from time to time.
MEMBERSHIP CHARGES & PAYMENT OPTIONS
6.1 All members are liable to pay all fees irrespective of the actual usage of SDS.
6.2 Members must elect to pay their membership fees in monthly or quarterly instalments by recurring debit or credit card payment.
6.3 SDS reserves the right to increase Membership fees at any point. If paying by recurring debit or credit card, the contract is for a minimum term of 1 month (the period). Following the first period, SDS OR ITS AGENT will continue to take monthly or annual payments/instalments unless written notice (an email will suffice) is received by SDS at least 30 days prior to the proposed termination date.
6.4 All monthly payments are priced for 11 months & divided & collected over 12 months so we do not cancel or suspend payment collection over the 4-week school closure period of 2 weeks in December / January & 2 weeks in July / August.
6.5 All bookings once booked are non-transferable and non-refundable.
6.6 By signing up to receive any SDS product or service the customer understands and gives permission for SDS to collect their relevant email addresses according to the SDS privacy policy.
CAUSES FOR MEMBERSHIP TERMINATION.
7.1 You may terminate your membership at any point with thirty days’ notice. Please note that if you relocate or become ill we will not refund payments to you as it is up to you to terminate your membership (and you can do this anytime) nor will we refund if you have opted for a quarterly membership as this service will still be available to you. Please also note that once you give 30 days’ notice if a recurring payment fails within this period it will be taken and you will have that period to still attend classes.
EXPULSION OF MEMBERS OR TERMINATION OF MEMBERSHIP BY SDS
8.1 SDS may expel members or may terminate the membership of any member:
8.1.1 without notice and with immediate effect if the members’ conduct, whether or not such conduct is the subject of a complaint by another member or group of members, is such that in the reasonable opinion of SDS, it may be injurious to the character, name or interests of SDS or is such that it renders the member unfit to associate with other members of SDS.
8.1.2 By notice in writing if any part of the fee or monthly membership charge which is due and payable remains unpaid thirty days after the due date for payment.
8.2 Lapses in membership payment will incur an Administration charge.
8.3. A member whose membership is terminated by SDS, shall forfeit all privileges of membership with immediate effect without an entitlement to any claim for any refund of their quarterly or monthly membership fee.
FACILITIES
9.1 Certain categories of membership do not include all of SDS’s services and facilities. Services and facilities not so included may be provided at an additional charge at SDS’s discretion.
9.2 SDS reserves the right to make reasonable alterations to the type of facilities provided without notice and SDS shall not be liable for any inconvenience caused by building works and for the provision of essential maintenance services that occur for 14 days or less, due to matters beyond our control or improvement works.
TIMETABLE
10.1 Information in relation to SDS’s normal hours of operation is available upon request. Such hours may be lengthened or shortened at the absolute discretion of SDS with or without any prior notice being given to members. SDS shall do its best to give members reasonable notice of change to such hours.
10.2 On occasions when necessary maintenance is required, SDS, or parts thereof, may be closed. Any refund given as a result of closure will only be made at the sole discretion of SDS.

JOINING A COURSE
12.1 You can book one of our courses online at www.streetdefence.net
HOW TO BOOK PRIVATE CLASSES
13.1 You can book private classes with an initial contact email, with your name, contact email & contact phone telling us what times/days you would like to train. We will then come back to you in regards to what availability we have for private classes and if this works we will book you in for your first private session.
PAYMENT
14.1 Payment for the membership or to join one of our courses must be made online at www.streetdefence.net
FEES
15.1 All SDS courses listed on the website are final. We are not currently VAT registered.
GROUP DISCOUNTS ON COURSES OR SEMINARS
16.1 A discount of 5% is given if 5 or more people book the same course (Bootcamp or Seminar), running on the same date, from within the same organization. This discount only applies to SDS courses (and is not for Group Classes, Private Classes and Corporate Classes). The discount will be refunded to the group after full payment from all parties is received.
SPECIAL REQUIREMENTS
17.1 SDS will make every effort to accommodate special requirements that have been notified at least 21 days in advance.
COURSE TRANSFERS
18.1 There is no charge for transferring your booking to the same course on an alternative date provided you notify the SDS in writing (email) more than 28 days before the start and if there is availability. However, a transfer fee of 20% of the course fee (plus VAT) will be payable if the notice is received less than 28 days before the start of the original course. No refund will be made in the event of a transfer and no more than one transfer will be allowed. Requests to transfer a course must be made in writing and can be sent by email to [email protected]
CANCELLING YOUR COURSE
19.1 If you notify SDS in writing (email) more than 90 days before the start date of a course, you will receive a full refund less an administration fee of 20% (plus VAT) of the course fee. If you withdraw for whatever reason within the 90-day period, the full fee will remain payable even if you are able to nominate a substitute attendee.
NON-ATTENDANCE
20.1 If you fail to attend a course on which you are booked without giving prior notice to the SDS as outlined in “CANCELLING YOUR COURSE” or miss part of a course for any reason whatsoever, we will not refund the course fee/s and we will not transfer you to any other course or other product
CANCELLATION BY SDS
21.1 Where circumstances dictate, SDS reserves the right to alter published courses, programs, fees or venues without prior notice. In the event of a course being cancelled by SDS, an alternative course date will be offered but no compensation will be paid for any additional costs incurred due to a cancellation of any course.
VENUES
22.1 Details of the specific venue will be sent to each attendee for all courses.
DRESS CODE
23.1 For all courses, seminars & classes we recommend participants wear flat-soled training shoes, tracksuit type trousers & a T-shirt.
LIABILITY
24.1 SDS does not accept responsibility for any injury or anyone acting as a result of information or views expressed in its classes/courses, including course material. Participants should take professional advice (e.g. police, lawyer) when dealing with specific situations. SDS is not related to any form or ideology of Krav Maga or Self-Defence courses or academies and is solely demonstrative. SDS does not accept responsibility for any action and/or reaction that you might take in street situations.
24.2 Events outside our control. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that are caused by events outside our reasonable control (Force Majeure Event).
24.3 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond SDS’s reasonable control and includes in particular (without limitation) the following:
24.3.1 strikes, lock-outs or other industrial action;
24.3.2 civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
24.3.3 fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disasters;
24.3.4 impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
24.3.5 impossibility of the use of public or private telecommunications networks;
24.3.6 the acts, decrees, legislation, regulations or restrictions of any government.
